Specific conditions of the NATIONAL online sales contract
These Specific Conditions of the Purchase Contract apply to online sales made through the websitewww.mew-jewellery.com(hereinafter, WEBSITE) whose ownership corresponds to MEW JEWELLERY.
The use by the client of the services proposed on the WEBSITE presupposes, in any case, the acceptance of these Specific Conditions of the online Purchase Contract, in the version published by MEW, at the time of the purchase order. Therefore, it is advisable that the customer read these Specific Conditions before proceeding to make a purchase, as well as the general terms and conditions of use of the portal.
We also ask you to read our Privacy Statement before placing your order. By using this WEBSITE or placing an order through it, the customer agrees to be bound by these Conditions and our Privacy Statement, so if you do not agree with all the Conditions and the Privacy Statement, You should not place any order.
1. Purpose of the contract
These particular online purchasing conditions apply to the purchase of any product present on the WEBSITE made by customers who have their delivery address in Spain, Andorra Gibraltar or Portugal.
The prices of each of the jewelry are indicated on the website on the date the order is placed. Prices are detailed for each item including taxes and fees. The amount of shipping costs and any other service is also specified and will be indicated to the customer in detail at the time they place the order.
The purchase service through the WEBSITE regulated in these Particular Conditions only allows the purchase of products and services to customers over 18 years old and with a delivery address in Spain, Andorra, Gibraltar, or Portugal.
"MEW reserves the right to cancel a customer's access account if fraudulent, speculative, or bad faith acts are detected in the use of this service."
MEW will modify and update, if it deems appropriate, articles and prices based on the company's commercial criteria, although the changes will not affect the products that have been accepted.
All product orders are subject to their availability and, in this sense, if difficulties arise regarding their supply, the order will be canceled and any amount that the customer may have paid will be refunded.
2. Hiring procedure
The information and details contained on the WEBSITE do not constitute a sales offer, but rather an invitation to do business. There will be no contract between the customer and MEW regarding any product until the order has been expressly accepted by MEW (even if a charge has already been made to your account). If the offer is not accepted and a charge has already been made to your account, the amount will be fully refunded to the customer.
To place an order, the customer must follow the online purchasing procedure and click on "Place order". After this, you will receive an email acknowledging receipt of your order (Order Confirmation). It should be noted that this does not mean that your order has been accepted, as it constitutes a mere offer to MEW to purchase one or more products. All orders are subject to acceptance by MEW, which will confirm such acceptance by sending an email informing you that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between MEW and the client (Contract) will be formalized only when the Shipping Confirmation with its corresponding invoice is sent to said client.
Only those products listed in the Shipping Confirmation will be the subject of the Contract. MEW will not be obliged to supply any other product that may have been ordered by the customer until its shipment is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism) that require us to reject the processing of an order after having sent the Order Confirmation. . MEW reserves the right to do so at any time, in its sole discretion.
3. Obligations of the parties
3.1. Payment
The price of the products will be the one stipulated at any given time on the WEBSITE, except in the case of a manifest error. Although MEW tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If MEW discovers an error in the price of the products that the customer has ordered, MEW, after informing them as soon as possible, will proceed to cancel the order. If MEW is unable to contact the customer, the order will be considered canceled and the amounts that have been paid will be fully refunded.
MEW is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in the price is obvious and unequivocal and could reasonably have been recognized by the customer as an incorrect price.
Prices for MEW products may vary, but (except as set out above) any changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the particularities of online purchasing, the price of the products indicated on the WEBSITE refers solely and exclusively to purchases made there, without necessarily coinciding with the retail price of MEW establishments. In accordance with the above, the price indicated on the WEBSITE is only considered binding for online purchases.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in a breakdown.
Once the customer has made their purchases, all the items they wish to purchase will have been added to their bag and the next step will be to process the order and make payment. To do so, the client will follow 5 steps:
- You will click "View Cart" at the top of the page to add the products you want to purchase.
- You will fill out and verify the contact information, your order details, the address to which you want the order to be sent.
- You will choose the payment method with which you want to make the purchase: credit card, debit card, Paypal or gift voucher and enter the corresponding information.
- You will accept the “Terms and Conditions”.
- You will confirm the purchase by clicking "Place order".
The customer can make payment with Visa, Maestro, Mastercard and Paypal cards. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway/Paypal screen that will authorize payment for the order.
By clicking "Authorize Payment" the customer is confirming that the credit card is theirs.
Credit cards will be subject to verification and authorization by the issuing entity; If said entity does not authorize payment, MEW is not responsible for any delay or lack of delivery and, ultimately, for not proceeding to formalize the sales contract with the client.
Descuentos
The discounts offered by MEW JEWELLERY will be exclusively applicable to the base price of the items and will not extend to additional customizations or shipping costs.
Value added tax (VAT)
In accordance with current regulations, any purchase made through the Website will be subject to Value Added Tax (VAT), which will be charged at the rate in force at the time of delivery.
For orders destined for Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of them.
3.2. Delivery
The shipment will be made through the company CORREOS and NACEX, outside of MEW, which undertake to deliver the product paid for by the customer to the delivery address within an approximate period of:

These deadlines may be extended from 10 - 28 business days for some of the following reasons:
- Product customization.
- Special items.
- Unforeseen circumstances not attributable to MEW JEWELERY.
It must be taken into account in any case that deliveries are not made on Saturdays or Sundays.
For the purposes of these Conditions, it will be understood that delivery has occurred or that the product(s) have been delivered at the time of signing for receipt of the same at the agreed delivery address.
The risks of the Products will be borne by the customer from the moment of delivery.
The customer will acquire ownership of the products when full payment of all amounts due in relation to them, including shipping costs, is received.
4. Withdrawal
The client does not have the right to withdraw from the contract once the item has been ordered, since it is personalized jewelry made to measure.
5. Existence of warranty
MEW offers its customers products and services of the highest quality.
The gold used to manufacture the pieces is 750 thousandths (18 carats) sterling silver, 925 thousandths sterling silver.
The MEW JEWELLERY diamonds of 0.30 carats or more come with their GIA certificate and comply with the conditions of the "Kimberley Process" (certification system for the international trade of diamonds not sourced from conflict countries).
Given the special characteristics of the products marketed by MEW on its website, there are slight differences between each product or service purchased, fundamentally due to the uniqueness and exclusivity of each and every one of the materials and stones used in its preparation, which is Furthermore, to a large extent, artisanal. Therefore, no two MEW products or services are exactly the same and, in any case, it is inevitable that the product delivered to the customer will differ slightly from that shown in the photographs included in the website purchase process (even if it had been the same). . In no case will these differences imply the delivery of products or services with worse quality of materials than those expressly mentioned on the Portal. Likewise, the client is informed and is aware that the size of the photographs contained on the Portal does not correspond to the real size of the MEW products offered.
Therefore, the client is informed and expressly consents to these circumstances and differences, without them being a cause for termination of the Contract.
In any case, without prejudice to what is established at the beginning of the section, the MEW JEWELLERY products purchased by the client through the purchase procedure established on the WEBSITE have the legal guarantee typical of consumer goods, that is, their compliance with its description on the WEBSITE and with these Specific Conditions.

7. Competent jurisdiction and applicable law
For any controversy arising from this online sales contract, the Spanish courts will be competent. Likewise, Spanish law (Recast Text of the General Law for the Defense of Consumers and Users) will be applicable in everything that is not provided for in this contract.

8. Intellectual and Industrial Property
All contents (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements that appear on the WEBSITE), unless expressly indicated otherwise, are the property exclusive of MEW or third parties.
No intellectual or industrial property right is transferred to the client over the WEBSITE or any of its component elements, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or use of any nature, by any means or procedure, of any of them, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.
The client may view and obtain a temporary private copy of the contents for their exclusive personal, private and non-collective use in their computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature. . The client must refrain from obtaining, or attempting to obtain, the contents by means or procedures other than those that in each case have been made available or indicated for this purpose or those that are usually used on the Internet (provided that the latter do not involve a risk of damage or disablement of the WEBSITE). The client must respect at all times all intellectual and industrial property rights on the WEBSITE, owned by MEW or third parties.
In any case, MEW reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Particular Conditions.
